Disclaimer

Release

I understand the hazards and risks which have been clearly stated and that I accept them before entering the event. I take full responsibility for any injury that I may sustain and in extreme cases death. If I refuse to accept this liability then I will not participate in the event.

I declare that I alone am responsible and liable for my actions and that Trailscape Limited will not be held accountable or responsible for any injury which I sustain during participation throughout the entire event.

We exclude liability for any persons taking part in the event under the influence of alcohol or drugs

Trailscape limited still has a duty of care and nothing in this disclaimer exempts us from misrepresentation, injury or death due to negligence.

Risk

I hereby confirm that I will be at least 18 years of age on the date of the event.

I agree that in taking part in Trailscape Limited events, I am fully aware of the physically strenuous nature of the event and that I participate entirely at my own risk. These risks include any personal injury caused and in extreme cases, death. No responsibility can be attached to Trailscape Limited, event sponsors, race directors or anybody involved in the organisation of the event.
I accept that Trailscape Limited is not responsible for any loss or damage to property.

I am fully aware and accept that I will take full care and responsibility for my own actions. Even though all areas of the course have been carefully risk assessed and that all efforts have been made to minimise the risks, these risks cannot be completely eliminated. These risks include but are not limited to the terrain, road crossings, road sections, the entire course and weather conditions.

I am fit and healthy enough to complete the event. I am not taking any medication which may impact on my ability to take part in the event and if I am, I have taken appropriate medical advice from a doctor before taking part in the event. Should any medical or physical condition arise which may effect my ability to take part in the event, I will withdraw in accordance with these conditions.

Alterations to race

Trailscape Limited reserve the right to alter the start time of the event. I understand and accept that alterations to the start time, route or course distance may be made at any time by Trailscape Limited. Any changes to the event will be communicated to participants at the event or earlier where practical.

Event cancellation

I understand that in the event of event cancellation, Trailscape Limited will endeavour to arrange an alternative date to host the event. Entry from the cancelled event will be transferred to the rearranged date. If participants are unable to compete on the rearranged date, entry from the cancelled event can be transferred to any other Trailscape Limited event which still has spaces available in the same price category within one year of the cancelled event. In exceptional circumstances, a refund may be provided, less an administration charge of £5.

Entry

By submitting an application online and paying the entry fee, I hereby understand and agree to abide by the terms and conditions and all instructions given by Trailscape Limited staff, employees and volunteers. Entry to Trailscape Limited events is only permitted once cleared funds of the full entry fee has been received by the organiser. An acknowledgement email will be sent to the email address given by the participant when signing up for the event.

Retiring from the race

I understand that in the event that I decide to retire from the race prior to completion I have a duty to inform the marshals at the closest check point and that I have a duty to relinquish my race number and chip timing device. In these circumstances I will be prevented from re-entering the race. I understand that as part of the safety protocol TrailScape Ltd may activate search and rescue in the event that I do not inform them of my retirement from the race and return my chip timing device. In this event I am aware that I may be liable for the cost of this search and rescue.

Disqualification

I will respect and obey the race rules and any instruction given to me by any staff or marshal directly employed by or volunteering for Trailscape Limited.

Trailscape Limited reserve the right to disqualify and/or remove from the event any participants at the event organiser’s discretion. Disqualification and removal from the event will occur if the participant fails to comply with the compulsory kit list, for safety reasons, to ensure the enjoyment of the event by the other participants or for any other reasonable reason. The mandatory kit list can be found on the Trailscape website, event information page. No refund will be offered in the event of disqualification or removal from the event.

Cut off times

I am aware that cut off times will be in place at each Trailscape Limited event. These cut off times are to ensure the safe and proper running of the event. The cut off times will be relayed to participants at the briefing on event day. Cut off times are limits on the time taken to complete certain sections of the race. If a participant fails to reach a cut off point before the designated cut off time, they will be redirected onto a shorter route or may be required to withdraw from the event. No refund will be offered in the event of a participant failing to meet a cut off time.

Race timing

Trailscape Limited will endeavour to provide a finishing time for each participant. Times will be published on the Trailscape website as soon as is practical after the event but Trailscape Limited cannot be held responsible for any computer or technical probems which arise. Failure to return a timing chip at the end of the race may result in a penalty charge of £25.

 

Running with a dog

Limited places may be available at Trailscape Limited events to run with a dog. The event organisers must be informed of the intention to run with a dog, permission saught and they reserve the right to refuse entry. Trailscape Limited cannot be held liable for any accident, injury, damage or loss to the participant, the dog or any equipment

Veterinary advice should be saught before entering a Trailscape Limited event. Liability insurance is required for any dogs which run in a Trailscape Limited event for any damages which the dog may commit. All dogs must be a minimum of 18 months of age at the time of the event and owners are responsible for their welfare. No pregnant or nursing bitches are allowed to take part. Any fouling must be cleared away and disposed of responsibly. No dogs should take part who are nervous of humans or other dogs. Dogs must be run in a harness attached to the runner  at all times via a shock absorbing lead and all dogs/canicross runners must abide by the Canicross rules and should have liability insurance. Any participants who are running with a dog will start the race after the rest of the runners and will not be eligible for winners prizes.  

Liability

Trailscape Limited strongly discourage the use of equipment which may impare participant’s concentration when competing. This includes but is not limited to MP3 players and mobile telephones. The use of these is banned at all road crossings and road running sections of the route. If a participant is seen to be using any of this equipment at a road crossing or road running section of the route, they may be disqualified and removed from the event in line with the Trailscape Limited disqualification protocol.

Trailscape Limited cannot be held responsible for any loss or damage to participant’s personal belongings. Bag drop facilities may be provided by Trailscape Limited but belongings are left by participants entirely at their own risk. Trailscape Limited shall not be liable for the actions of any supporters or third parties. Trailscape Limited shall not be liable for any loss or damage whatsoever arising out of the participation in the event; loss of reputation, loss of business, wasted expenditure or pledge made to charity by you or on your behalf.

Communication

Trailscape Limited primarily use email to communicate with its participants. By entering a Trailscape Limited event, I agree to receive emails regarding the event. It is the participant’s responsibility to ensure their spam filters allow the receipt of emails from Trailscape Limited. Trailscape Limited can only be held responsible for ensuring that email contact is made to the email address given when signing up for the event.

Data protection

I agree that my personal information (including medical data) may be kept and used by Trailscape Limited for the purposes of administration and staging of the event. Medical dat will only be used to allow for the appropriate medical assistance on event day.

I agree that my name and contact details can be used by Trailscape Limited for; providing information and marketing for the event; adding me to a mailing list to keep me informed about other future Trailscape Limited events which it is thought would be of interest. If you would not like to be contacted about events other than the event you have signed up for, please contact Trailscape Limited by email and your contact details will be removed from the mailing list.

Your contact details and personal information are for the sole use of Trailscape Limited. No personal information or contact details will be sold or passed on to third parties.

Allergies

It is important to note that some of the food products provided by Trailscape Limited on event day may contain nuts, nut oils or have been produced alongside products containing nuts or nut oils. Trailscape Limited cannot be held responsible for any issues resulting from food allergies.

Withdrawal policy

There are considerable costs involved in staging Trailscape Limited events. As such, these costs are reflected in the withdrawal policy. If notification is given by email four weeks or more before the event date, entry may be transferred to any other Trailscape Limited event which has space in the same price category within one year of the original dated event. If less than four weeks notification of withdrawal is provided, no transfer of entry and no refund will be offered.

I understand and agree that entry to the event is personal to me. Entry is not transferable and I am prohibited from swapping, selling or transferring my place. If found to be in breach of this agreement, Trailscape Limited reserve the right to exclude me from this and any future events. 

Photography

I understand and accept that photographs and video footage may be taken of the event and its participants and this material used for promotional and marketing purposes.

Final decision

All decisions and rulings made by Trailscape Limited, are considered final. I agree to comply with all instructions and guidelines given by Trailscape Limited staff, employees, marshals and safety personnel. I agree that Trailscape Limited will be the final arbiter on all decisions relating to safety, organisation of the event, the rules of the event, the timings and placings.
